Protecting your Privacy

TEQBALL USA LLC ("TEQBALL USA" or "we", "us", or "our") is committed to protecting the privacy of your personal information. This Privacy Policy (the “Policy”) applies to the TEQBALL USA webshop (referred to in this Policy as the "Website"). This Policy describes the information we collect and how we use and disclose it. By visiting our Website and using our services, you are accepting the practices described in this Policy. If you do not agree to the terms of this Policy, please do not use the Website or the relevant services.

 

Consent to Collection and Processing

The Website and our services may be operated or supported from, in whole or in part, from a country other than the United States. You consent to having your personal information transferred to and processed outside of the United States.

 

What Information do we collect and store?

Our privacy policy is simple: Except as disclosed below, we don't sell, trade, give away, or rent your personal information to any company outside of the TEQBALL Group (please refer to our Terms and Conditions for the definition of TEQBALL Group). One of the basic principles we've tried to follow is to limit the information we collect from and share about you. 

 

Personal Information

We collect and store information that you provide to us, including through the Website or our customer service associate(s) or that we receive from third parties (such as companies providing commercially available databases). 

 

When you place an order, we collect and store the following information that you provide: name, billing address, shipping address, email address, telephone number. However, may not access your payment information (credit / debit card information (name, number, expiration date, CVC number, PayPal or Google Pay or other IDs). These will be separately processed by the relevant payment provider. If you sign up for a user account, we may ask for your name, e-mail address, password. Optionally, when signing up for an account, you may provide us with your shipping information (phone number, shipping address) and billing information (if different from shipping information): phone number, billing address. We will also collect the following additional information, if you choose to provide it when you sign-up for an account: social identifier if you choose to log in to your account via social media and age. If you choose to apply certain discount codes when making purchases, we may store the information associated with that code – which may include, for example, a school or veteran status, and connect that information with your profile. We may collect your e-mail addresses, your zip code and any other information if you subscribe to our newsletter and we collect your mobile number if you opt in to receive text messages. You may unsubscribe at any time by following the instructions located within each newsletter or linked to each text message. We also collect and store your geolocation information. If you participate in a contest or sweepstakes, we may collect the following information to administer the sweepstakes: your contact information, your product size information, your preferences, your location and other information you provide to us. When we run a contest or sweepstakes, it will be accompanied by a set of rules. The rules for each contest/sweepstakes will specify how the information gathered from you for entry will be used and disclosed, if it is different than as described in this Policy. Personal information will be collected only if you voluntarily submit it to our sponsors or us. When processing your orders, a unique order number and other technical identifiers will be assigned to such transactions. These may also qualify as your personal information. We store your order history. Similarly, when you are contacting us regarding your order, submitting us a request or simply providing us feedback of your experience, you provide us with your name, contact details, information necessary to verify your identity and other relevant information. We process these too in compliance with this policy.

 

Usage Information

Through your use of our Website, we may also gather certain information about your use of our Website ("Usage Information"). Generally, this information is collected through "traffic data". We collect and store certain other information automatically whenever you interact with our Website. For example, we may collect your IP address, browser information and reference site domain name every time you visit our Website. We also collect information regarding customer traffic patterns and site usage. This information is used to analyze and improve our Website, to provide our customers with a fulfilling shopping experience, and to personalize the Website, our communications with you, and your shopping experience.

 

How do we use cookies, advertising, and online tracking?

Like many websites, we use "cookies", files stored on your computer's hard drive by your browser to identify account holders and to optimize their shopping experience. Cookies also allow us to hold selections in a shopping cart when a user leaves this Website without checking out and send you reminder e-mail about your shopping orders and other shopping opportunities. Interest-Based Advertising

We may also use third party companies, including Google Analytics and Google Adwords, to measure and target ads on our behalf about products and services tailored to your interests. We allow these third-party companies to use cookies, web beacons, pixel tags and similar technologies to collect or receive information about your interaction with us on our Website and elsewhere on the internet (“Tracking Data”) and use such Tracking Data to display ads for TEQBALL USA and our affiliates when you visit this or other websites. Is Information collected from children?

We do not knowingly collect or solicit personal information from children under thirteen (13). If you are under the age of thirteen (13), you may not use our Website or provide any information to us. If we become aware that information has been received about a person under the age of thirteen (13), we will work to remove and permanently delete that information to the extent reasonably and commercially possible. If you are a parent or guardian who believes that your child under the age of thirteen (13) has submitted information to us, please contact us. If we verify that you are the parent or legal guardian, we will coordinate with you to discuss any personal information actually received from your child and how that personal information may have been shared or used.

 

How do we use your personal information?

We may use your personal information to provide the products and services that you have ordered or requested, to process and ship orders, to provide customer service, to provide other services to you, to detect fraudulent activities, and to personalize the Website, our communications with you, and your shopping experience. For example, when you create an account, you can use your account details to log in from any location and on any device.  Your information also may be used to contact you about sales, new products, new site features, special offers, and personalized offers based on your location, unless you have opted to not receive promotional communications. The information we collect may be combined with information obtained from companies within the TEQBALL Group and from other companies. We may also combine this information with other information we collect as you interact with our social media and marketing messages we send you. Aggregating data allows us to update and correct the information contained in our database and to provide you with product recommendations and special offers.

 

How do we share your personal Information?

TEQBALL Group - Except as described in this Policy, we will not disclose your personal information outside of TEQBALL Group without your consent. We may share your personal information with other group entities if the other entities are acting as our service providers and processing your personal information on our instructions or on our behalf.

 

Partners - The Website may allow you to choose to share your personal information with select business partners so that they can contact you about their products, services or offers. We do not provide our Partners with your personal information without your consent.

 

Service Providers - We may hire other companies to provide services on our behalf, such as marketing, analytics, payment processing, sales tax compliance, shipping, stocking orders, providing customer service, and fraud protection. These service providers have access only to such personal information appropriate to perform their functions and are contractually obligated to maintain the confidentiality and security of your information. They are restricted from using, selling, distributing or altering this data in any way other than to provide the requested services.

How do we use Usage Information?

We use Usage Information to help us determine how people use parts of the Website and who our visitors are. This allows us to improve our Website and ensure that it is as appealing as we can make it for as many people as possible. We also use Usage Information to detect fraud and to provide statistical "ratings" information in aggregated form to our partners and other third parties about how our users collectively use the Website.  We may combine Usage Information about you with other information, including Personal Information, about you in order to personalize the Website and our communications with you and to provide you with information likely to be of interest to you.

 

What steps are taken to help secure personal information?

An athlete can't play without confidence, and you shouldn't order from a company that doesn't follow secure data practices. Our goal is to deliver performance to you in every way. That includes security. We use reasonable security procedures to protect your information. However, no data transferred over the Internet is guaranteed to be 100% secure. Personal information collected at our Website is stored in secure operating environments that are not available to the public. To protect the security of your information during transmission, we use Secure Sockets Layer (SSL) software, which encrypts information you input. Most browsers will give a visual indication of when your connection is secure. For example, Internet Explorer will show a padlock icon in the lower right of the browser window.

By using our website, you consent to the transfer and use of your personal information in accordance with this Policy.

 

Security of payments and other suspected breaches

We engage payment service providers that use appropriate security measures when processing your payment information such as the industry standard encryption protocol known as Secure Socket Layer (SSL) to keep your order information and account secure. Nonetheless, if any unauthorized charges appear on your credit card as a result of shopping on the Website or you find that someone may have hacked your account, please notify us immediately using the contact information above and, in case of unauthorized charges, also please get in touch with your credit card provider in accordance with its reporting rules and procedures.

 

Applicable Law and Jurisdiction

California state law governs the interpretation of this Policy and applies to claims for breach of them regardless of conflict of laws principles. Both parties consent to exclusive jurisdiction and venue in courts sitting in the state of California. Both parties waive all defenses of lack of personal jurisdiction and forum non conveniens.

 

Changes to This Privacy Policy

We will update this Policy as needed to reflect changes in our services and customer feedback. When we post changes to this Policy, we will revise the "last updated" date at the top. You are responsible for checking for updates of this Policy each time you use our Website. We encourage you to review this Policy from time to time to ensure that you understand how we collect, use, share, and secure your personal information. PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

Consumers residing in California have some additional rights with respect to their personal information under the California Consumer Privacy Act (“CCPA”).  If you are a California resident using our Website, this notice applies to you and supplements the main Privacy Policy

As we are just opening our business, we have not processed your personal data before. However, you may read more about our envisaged processing of your personal information below. Please note, however, that to other processing operations, such as recruiting, a separate policy applies and this policy is designed to inform you on our practices relating to the Website (webshop) only.

Your California Consumer Rights 

Access

You have the right to request access to the specific pieces of personal information we have collected about you in the last 12 months. You may make this request up to two times in a 12-month period.  You may also request additional details about our information practices, including the categories of personal information we have collected about you, the categories of sources of such collection, the business or commercial purpose for collecting or selling personal information, the categories of third parties with whom we share and sell your personal information, the categories of personal information we have disclosed and sold about you in the preceding 12 months, and the categories of third parties to whom we sold personal information in the preceding 12 months.

Please note that there are circumstances in which we may not be able to comply with your request pursuant to the CCPA, including when we cannot verify your request and identity and/or when there is a conflict with our own obligations to comply with other legal or regulatory requirements. We will notify you following submission of your request if this is the case.

Portability

You may also request to receive specific pieces of Personal Information we collect about you in the last 12 months such as (1) the categories of Personal Information collected about you; (2) the categories of Personal Information sold; (3) the categories of third parties to whom the information was sold; and (4) the categories of Personal Information that were disclosed for a business purpose. You may make this request up to two times in a 12-month period.

Deletion / Right to be forgotten

If you are a California consumer, you also have the right to request deletion of your personal information subject to certain exceptions. Therefore, we will not be obliged to comply with your request to delete your personal information if such information it is necessary to

i) complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a product or service you requested, or reasonably anticipated within the context of our ongoing relationship, or otherwise perform a contract between us;

ii) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

iii) debug to identify and repair errors that impair existing intended functionality;

iv) exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law;

v) comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code;

vi) engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the business’ deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent;

vii) to enable solely internal uses that are reasonably aligned with your expectations based on the our relationship;

viii) comply with a legal obligation to which we are subject.

Opt-out and equal treatment

You have the right to opt out of sales of personal information, and to receive equal service and price and not be discriminated against even if you exercise any of your CCPA rights.  

General information on exercising your rights

California consumers may make a rights request by sending us an email to privacy@teqball.us or by sending a letter to 10811 Washington Blvd., Ste 400, Culver City, CA 90232.  Your request must include sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, which must include the following information:

i) your email address,

ii) your full name,

iii) if you have a user account, your account id,

iv) the indication that you are an authorized agent as per this policy,

v) the type of request you wish to make:

a. Information on the data processed about you within the last 12 months (access right)

b. Requesting copies of personal information processed about you within the last 12 months (portability)

c. Deleting your account (deletion / right to be forgotten)

When contacting you, to process your request we may request further information from you.

In general, the deadline for processing your request is 45 days starting from the date on which we can verifiably identify you. The period may be extended up to 90 additional days where it is necessary due to complexity and the number of requests. Should we need to extend this deadline, we will inform you within 45 days from the receipt of your verifiable request. If we cannot fulfill your request we will inform you without delay (and in no event longer than the time period permitted for response) the reason for refusal and any right to appeal you may have. 

Using an Authorized Agent

You may use an authorized agent to exercise your rights under the CCPA.  We may request evidence from the authorized agent that you have provided that agent with signed permission to submit the requests on your behalf. We may ask you to verify your identity with us directly or we may ask you to directly confirm with us that you provided the authorized agent permission to submit the request.  For more details on how you can use an authorized agent, or if you are an authorized agent seeking to make a request on behalf of a California consumer, please contact us. 

Financial Incentives

We offer various financial incentives. For example, we may provide discounts, early access to prthoducts, special offers and other benefits to our registered users and the members of our special programs, if any.  We may also offer discounts for subscribing to our newsletters and marketing communications.  And in some cases, we may offer access to products and services in exchange for, among other things, feedback about those products and services.  When you participate in the financial incentives we offer, we collect personal information from you, such as identifiers like your name and email address, and commercial information like your purchasing habits and profile information such as product preferences. Some of our sweepstakes and contests may be considered a financial incentive. Most of our sweepstakes and contests require that you have an account with us. To create an account, you'll need to provide identifiers, including your name, email address that qualify as personal information under the CCPA.

You can opt into a financial incentive by following instructions surfaced in connection with sign-up, and you may opt-out of the incentive at any time by contacting customer service at info@teqers.com. In some cases, we may provide additional terms and conditions for a financial incentive, which we will provide to you when you sign up. The value of your personal information is reasonably related to the value of the discount or benefit presented to you.
